Official Rules 

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. 

PLEASE READ THESE OFFICIAL RULES CAREFULLY. BY ACCESSING OR PARTICIPATING IN 

THE COMPETITION, YOU (“Participant,” “you”, “your”) AGREE TO BE BOUND BY THESE OFFICIAL RULES AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, DO NOT PARTICIPATE IN THE COMPETITION. 

 

 

Article 1. SPONSOR 

The organizer of this contest is PENTALOG FRANCE SAS with registered office at 9 rue du 4 Septembre, 75002 Paris – France, with registration number 400 300 190   (hereinafter referred to as the “Sponsor”). 

 

Article 2. ELIGIBILITY 

This free competition is a trade-only promotion open for participation by individuals who are (i) at least 18 years of age at the time of entry, (ii) legal residents of Morocco and (iii) Front End Developers, Mobile Developers, Web Developers, Full Stack Engineers with knowledge of React Native. 

 

The language of the contest is English, and the communication channel is made through Pentalog Connect webpage.  

 

Targeted specialization:  React Native  

 

The following individuals will be excluded from participation:  

  1. Individuals on the List of Specially Designated Nationals and Blocked Persons or the Foreign Sanctions Evaders List maintained by the United States Office of Foreign Assets and Control (“OFAC”), or who have been previously indicted for or convicted for any Patriot Act Offense or similar offense.  

  1. Sponsor and its parent, subsidiary and affiliate companies, employees and the immediate family (spouse, parents, siblings and children) and household members of each such person are not eligible to participate, enter, or win any prize.  

  1. Individuals who directly or indirectly participated in the design, production, or management of the Competition.  

  1. Government officials and their immediate family members are not eligible to participate or receive a prize. For the purposes of this Competition, government officials are defined as individuals employed by government departments and agencies, including all federal, state, provincial, county, city or municipal government officials (where applicable), statutory boards, public bodies, and anyone employed by a government-owned or controlled company. By participating in the Competition, you are acknowledging that you are not a government official and/or immediate family member of a government official, and are willing to provide evidence of the same, if requested. Sponsor may also exclude, at its sole discretion, Participants from jurisdictions that require any type of registration with local authorities of the Competition and/or the Sponsor. 

 

Sponsor may request any participant to provide proof that such person is participant selected as a potential winner. In the event of a dispute as to the identity of a participant, a submission will be deemed to have been submitted by the authorized account holder of the e-mail address associated with the Submission. The “authorized account holder” is the natural person assigned to an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A selected Participant may be required to provide Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the submission. Potential winner is subject to verification before any prize will be awarded. By participating in the Competition, Participants fully and unconditionally agree and accept these official rules (“Official Rules”) and Sponsor’s decisions, which are final and binding in all matters related to the Competition. Winning is contingent upon fulfilling all requirements set forth herein. 

 

Article 3. COMPETITION PERIOD 

This Competition will follow the schedule outlined below, subject to adjustment as reasonably necessary: 

Submission Period:  

Begins on December 18, 2023, at 09.00 am Western European Time (WET)  

Ends on January 15, 2024, at 00.00 am WET (“Submission Period”) 

 

Article 4. WINNER SELECTION AND CONDITIONS OF PARTICIPATION 

 

Winner Selection: Approximately five business days after the Submission Period is over (subject to change).  

 

HOW TO ENTER: Eligible Participants may enter the Competition by taking following the steps:  

1 – Participants must create an account completing all required information in Pentalog Connect: https://www.pentalog.com/it-outsourcing/morocco-react-native-dev-challenge/?preview=true#signup-b2c-react-native-challenge-morocco 

 

2 -  To participate, potential Participants must register and provide the following details during the Submission Period : name, surname, email, company name, country, city, years of experience, phone number and LinkedIn profile.  

3- Participants must complete the React Native quiz advanced level, which is available through Pentalog Connect.  

 

(each and together, a “Submission”). 

 

All Submissions must be received by the end of the Submission Period. Sponsor’s clock is the official timekeeper for this Competition. All requested information must be included in your entry and Submission to be eligible to win. Proof of submitting an entry is not considered proof of delivery to or receipt by Sponsor of such entry. Limit one entry per person.  

 

Transactions of any kind carried out using the identifier and code assigned to a Participant, following registration, are irrefutably presumed to have been carried out under the responsibility of the Participant. 

 

Article 5. DISQUALIFICATION 

Submission containing any prohibited elements and/or that are in violation of a law or otherwise deemed by Sponsor, in its sole discretion, to be prejudicial to Sponsor or any other person or party affiliated with the Competition or inappropriate in any way, may be disqualified. Sponsor may in its sole and absolute discretion disqualify any Participant who is responsible for a Submission that Sponsor deems to violate the Submission Guidelines or the Official Rules. Sponsor may also, in its sole discretion, disqualify any Participant who engages in behavior that is disparaging or derogatory of Sponsor, members of the judging panel or any other person or party affiliated with this Competition, or of any other Participant, or that is deemed unsportsmanlike by Sponsor. Sponsor may also disqualify any Participant who violates any law, rule, statute, or order of any jurisdiction in connection with the Competition, or whose participation in the Competition results in Sponsor’s, or puts Sponsor at risk of, violation of any law, rule, statute, or order of any jurisdiction. Sponsor may also disqualify any potential or confirmed winner (a) who engages in behavior that: (i) is illegal; (ii) (as determined by Sponsor in its sole and absolute discretion) is inappropriate, threatening, illegal or that is intended to annoy, abuse, threaten, harass, victimize, degrade, or intimidate any other individual or group of individuals on the basis of religion, race, ethnicity, sexual orientation, gender, age, or disability; or (b) if Sponsor discovers content on potential winner’s or winner’s social media or other public locations which might in the reasonable opinion of Sponsor expose Sponsor to disrepute, contempt, scandal or ridicule, or shock, insult or offend the public; and in each case Sponsor reserves the right to not award the potential winner a prize, or to withdraw or terminate any prize already awarded. Each Participant further agrees to indemnify and hold harmless the Sponsor and each of their respective employees, officers, directors, and agents from and against any claims, lawsuits, liabilities, and expenses (including attorney’s fees) arising out of the use of the Submission submitted in the Competition and/or their participation in the Competition. 

 

 

Article 6. NO CONFIDENTIALITY 

Participants agree and acknowledge that their Submissions, and participation in the Competition will not be treated as confidential and may be made available to the public, including, but not limited to, posting on the Internet. Sponsor does not guarantee any confidentiality with respect to any Submission. 

 

Article 7. WINNER DETERMINATION, SELECTION AND NOTIFICATION 

The winner will be considered the participant who obtained the total highest score in the quiz (hereafter the “Winner”).  

 

WINNER DETERMINATION AND NOTIFICATION: On or around January 22, 2024, the Winner will be informed via email at the email address submitted during registration that they have been selected as Winner pending verification of their eligibility to be completed no later than ten business days from the date on which Sponsor first attempts to notify potential winner (the “Winner Documentation Due Date”). If Winner do not respond to the email within 5 business days confirming reception of this communication, Sponsor will call Winner to the telephone number indicated in the Submission. Winner may be asked to complete the following documents: affidavit of eligibility, tax documentation, and, if applicable, except where prohibited, a release of liability and a publicity release (collectively, “Winner Documentation”) to receive a prize. Winner who cannot accept the prize for any reason will be ineligible. If a potential winner is ineligible, does not return the completed and executed Winner Documentation by Winner Documentation Due Date, cannot accept the prize or refuses the prize for any reason, Sponsor may disqualify such Participant and award the prize to the next highest scoring Participant. 

 

The Winner will receive the following price:  

  • One (1) Sony Console PlayStation 5, Standard Edition + one (1) EA Sports FC 24  

 

Prize may not be transferred or assigned. Prize may be subject to withholding taxes and/or to taxation. The winner must provide Sponsor with a valid taxpayer identification number (as applicable) before any prize will be awarded. The winner may be subject to a tax on the value of any prize awarded. The winner is solely responsible for reporting and paying any and all applicable taxes; if required by law, Sponsor shall be entitled to withhold and remit to the appropriate taxing authorities the amount of any tax or taxes due, which shall be discounted from the Prize. The winner understands and agree that the winner may be responsible for taxes exceeding the amounts listed above, for reasons such as, without limitation, winner’ tax bracket. Potential winner should consult an accountant or tax professional to determine tax implications in accepting and using any Prize. As a result of any local laws and restrictions, potential winner may not be eligible to receive a prize and prize will therefore be forfeited. In the event a prize is forfeited for any reason, including for non-compliance with these Official Rules or with applicable regulations, Sponsor may disqualify such potential winner and award the prize to the next highest scoring Participant.  

 

No prize substitution or exchange will be allowed, except by the Sponsor, who reserves the right to substitute the Prize for a prize of equal or greater value at any time and for any reason.  

 

Article 7. INTELLECTUAL PROPERTY  

Participant agrees that all materials, products, and services provided on the website are Sponsor’s property including its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. You also agree that you will not reproduce or redistribute Sponsor’s intellectual property including but not limited to its brand, name, trademark, in any way, including electronic, digital, or new trademark registrations. All brands, logos, texts, images, videos and other distinctive signs reproduced on the site as well as on the sites to which it allows access through hypertext links, are the exclusive property of their owners and are protected as such by the provisions of applicable intellectual property regulations. Their unauthorized reproduction constitutes an infringement liable to criminal penalties. 

 

Article 8. PUBLICITY 

By participating in the Competition, except where prohibited by law, each Participant irrevocably grants the Sponsor and their respective successors, assigns and licensees, the right to use such Participant’s name, likeness, and biographical information, and any other personal characteristics, in any and all media for any purpose, including without limitation, to advertise, market, and promote Sponsor or the Competition or other promotions, and each Participant and/or winner hereby release Sponsor from any liability with respect thereto. 

 

Article 9. PRIVACY 

The participants’ information (name, surname, email, company name, country, city, years of experience, phone number and LinkedIn profile) are processed by the Sponsor to allow their participation in the Competition, handover the prize and/or communicate with the winner for any other reasons related to the contest or future collaboration, by case. 

 

By participating in this Competition, the Participant provides their consent for the Sponsor to process their personal data. The purpose of processing this information will be to organize, manage and conduct marketing activities regarding the Competition as set out in these Official Rules. The Sponsor will process the personal data in accordance with the applicable data privacy laws and Sponsor’s Privacy Policy available at the following address: https://www.pentalog.com/privacy/. Sponsor may also share the Participant’s personal data with affiliate companies of the Sponsor’s corporate group and partner organizations for the management of the Competition. Participants may exercise any of their rights regarding the processing of their personal data by contacting contact@pentalog.com. Any omission or inaccuracy in the data provided by the Participant will be considered grounds for disqualification, meaning that Participant will not be able to participate in the Competition and/or receive any prize.  

 

 

Article 10. ERRORS AND UNAUTHORIZED ACTIVITIES 

In the event that the operation, security, or administration of the Competition is impaired in any way for any reason, including without limitation, fraud, virus or other technical problem, or any other reason beyond the control of 5 Sponsor, Sponsor may, in its sole discretion, either: (a) suspend the Competition to address the impairment and then resume the Competition in a manner that best conforms to the spirit of these Official Rules; or (b) cancel or terminate the Competition and, if feasible, award the prizes from among all eligible entries received up to the time of the impairment based on skill criteria described in these Official Rules. Sponsor reserves the right to modify prize award procedures. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry and participation process or the operation of the Competition or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Competition may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. 

 

ARTICLE 11. CHANGES 

The Organizer reserves the right to modify and/or supplement these Official Rules at any time, as well as the right to suspend and/or terminate/interrupt/extend the Competition at any time, provided that the participants are notified in advance of any modification of any of its provisions. Any changes/completions will be communicated to the public by publishing them on the website, before they enter into force. ARTICLE 12. RELEASE 

Subject to any applicable laws, by participating in the Competition, you agree to release Sponsor, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively, “Released Parties”), from and against any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Competition to the extent possible under applicable law (except where the Sponsor is at fault through intentional or negligent conduct), including without limitation: (a) acceptance, possession, use, misuse, or nonuse of the prize that may be awarded; (b) any incorrect or inaccurate information, whether caused by participants, printing errors or by any of the equipment or programming associated with or utilized in the Competition; (c) technical and/or communications malfunctions, errors or failures of any kind; (d) unauthorized human intervention in any part of the Competition; (e) technical or human error which may occur in the administration of the Competition or the processing of entries; (f) if Sponsor must cancel or terminate the Competition for any reason; (g) if any prize cannot be awarded due to circumstances beyond Sponsor’s reasonable control; and (h) any and all claims, demands, causes of action, judgments, costs and expenses (including attorneys’ fees) arising from a claim that your Submission or Portfolio infringes the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party. You agree that in any cause of action, the Released Parties’ liability shall, to the extent permitted by applicable law, be limited to any cost of entering and participating in the Competition and in no event shall the Released Parties be liable for attorneys’ fees or other legal costs. You acknowledge that the Released Parties have neither made nor are in any manner responsible or liable, to the extent permitted by law, for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize.  

 

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

 

ARTICLE 13. SEVERABILITY 

If a court finds part of these rules illegal, the rest will continue in force. Each of the paragraphs of these rules operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force in effect. 

 

ARTICLE 14. APPLICABLE LAW AND DISPUTES 

Except where prohibited, all issues and questions concerning the validity, construction, interpretation, performance, and enforcement of the Competition and these Official Rules, or the rights and obligations of you and Sponsor, shall be governed by and construed in accordance with the laws of France, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than France. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or in connection with this Competition or any prizes awarded shall be resolved individually, without resort to any form of class action, exclusively by arbitration pursuant to the Rules of JAMS, then effective.  

 

Article 15. LIMITATION OF LIABILITY.  

YOU FURTHER AGREE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.
